HankoArtStudio, sculptor, status: micro-entrepreneur, SIRET: 105842645, address: France, 06400 Cannes, 88 Av. du Maréchal Gallieni, email: gennadiiko@gmail.com. VAT not applicable, art. 293 B of the French Tax Code (CGI). Website: hankoart.com. Hosting provider: Hostinger.
2. Scope
These terms apply to all orders placed on this website. By placing an order, the Buyer confirms having read and accepted them. The Seller may amend these terms; the version in force on the date of the order applies.
3. Products
Handmade sculptures in natural wood, generally one-of-a-kind. Photographs and descriptions are as accurate as possible, but colours may vary depending on your screen. The texture, grain and shade of wood are unique to each piece and are not defects. Dimensions and weight are given with a tolerance of ±2 cm. A sold piece is removed from the website. If two orders arrive at the same time for the same piece, the Seller will inform the Buyer and refund the order that cannot be fulfilled.
4. Prices
Prices are in euros. Shipping costs are shown before payment. The price is fixed at the time of the order. Import duties and taxes for countries outside the EU are not included (see the “Shipping” page).
5. Ordering
- Choose the piece and add it to the basket.
- Enter your address and choose a delivery method.
- Check your order, including the total price and shipping costs.
- Accept these terms.
- Click the button that states clearly that placing the order carries an obligation to pay.
The contract is concluded once payment is made and the Buyer receives the order confirmation by email. The Seller may refuse an order for a legitimate reason (for example, an incomplete address or a dispute over a previous order).
6. Payment
Payment is made by bank card and by the other methods offered by Stripe, through the Stripe service. The payment is charged when the order is placed. Card details are processed by Stripe and are not shared with the Seller.
7. Made-to-order pieces
The design, dimensions and wood species are agreed in writing before work begins. Production time: 3 weeks. 5 design revisions are included in the price. Deposit: 70 %, balance payable before shipping. Once work has started, cancellation is possible only with the deposit retained. Pieces made to the Buyer’s specifications or clearly personalised are not eligible for the 14-day right of withdrawal (Article L221-28 3° of the French Consumer Code). The Buyer is informed of this before payment.
8. Delivery
Delivery terms are set out on the “Shipping” page, which forms part of these terms. The dispatch time is stated on the product page. If none is stated, the piece is shipped no later than 30 days after the order. The risk of loss or damage passes to the Buyer when the Buyer, or a third party designated by the Buyer, takes physical possession of the parcel. On receipt, please check the packaging. In case of visible damage, note your reservations in writing with the carrier and inform the Seller within 3 days, with photos. If delivery is late, the Buyer may, in the cases provided by law, ask the Seller to deliver within a reasonable additional period and, failing that, cancel the contract in writing.
9. Right of withdrawal
The Buyer has 14 days to withdraw from the purchase. The procedure is described on the “Refund Policy” page.
10. Legal guarantees
Regardless of anything stated on the website, the Seller is bound by:
- the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) for 2 years from delivery. The Buyer may request repair or replacement; if this is impossible or disproportionate (for example, for a unique piece), the Buyer may obtain a price reduction or cancel the sale;
- the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code) for 2 years from discovery of the defect.
The guarantees do not cover damage caused by improper storage or handling, or natural changes in the wood (for example, fine cracks caused by overly dry air when care advice is not followed).
11. Intellectual property
The works, photographs and texts on the website are protected by the French Intellectual Property Code. Purchase transfers ownership of the physical object, but not the right to reproduce the work, produce copies of it or use its image commercially without the artist’s written permission. The artist retains the right to show photographs of sold works in a portfolio and on social media.
12. Certificate of authenticity
Each original work comes with a signed, numbered certificate of authenticity.
13. Personal data
The processing of personal data is described in the privacy policy. Rights of access, rectification and erasure: gennadiiko@gmail.com.
14. Force majeure
The Seller is not liable for failure to perform obligations due to force majeure (natural disaster, carrier strikes, border closures, etc.). The parties will inform each other without delay.
15. Complaints and mediation
For any question, please write first to gennadiiko@gmail.com: reply within 2 business days.
16. Governing law
The contract is governed by French law. Other language versions of the website are translations; in case of discrepancy, the French version prevails. Mandatory provisions of the consumer’s country of residence are not affected.
